How to Do an Oklahoma Business Search:
Start your business search with a few well-researched business name options and find out if any matching or similar names are registered with the SOS. Once you've checked name availability online, you'll also want to perform a state and federal trademark search before reserving your business name.
Conduct an Oklahoma business search online.
Visit the Oklahoma SOS website.
The Oklahoma SOS website features an online search tool on its "Business Services" page. Users can search for business entities by name and investigate name availability.
Navigate to the business entity search tool.
Open the business entities search page and click "Advanced Search" below the entity name search field.
Select a search type.
Having clicked "Advanced Search," you should see a list of search options. Select "Name Availability" to look up business names that may be in conflict with yours. If you choose the option "Search All," the search results will include names that contain any of your keywords and variations thereof, as well as expired entity names.
The name availability check only facilitates a preliminary search. The Oklahoma Business Filings Department officially confirms whether a name is available once a name reservation or entity formation documents have been filed and approved.
Conduct the name search.
Enter your business name in the search field next to "Entity Name" and click "Search."
Conduct several searches entering variations of your desired name, such as alternate spellings and different prefixes and suffixes, to check for similarly spelled and similar-sounding business names.
Review the results.
Scroll through the search results to check for similar business names. If a name is an exact match or too similar to your desired business name, you will not be able to register your business with the SOS under that name.
If you do not find any entries that match or are very similar to your business name, it is likely available. Keep in mind that the Oklahoma Business Filing Department makes the final determination of a name's availability. You will have to file a name reservation or entity formation documents for this to be done.
Click on the hyperlinked filing number next to the business name in the list of results to see additional details about the business.
Additional Oklahoma business search steps.
Perform trademark searches.
Registering your business name with the SOS prevents other businesses from registering their business under the same or an indistinguishable name, but does not give you exclusive rights to the name. It might even be trademarked.
Infringing on another entity's trademark rights can have serious legal consequences, which is why it is always a good idea to check for matching or similar state and federal trademarks.
Use the Oklahoma trademark search tool to check for state-level trademarks.
Search the United States Patent and Trademark Office's (USPTO) trademark database for federal trademarks.
Reserve your business name.
File an Application for Reservation of Name with the Oklahoma SOS to ensure that your business name is still available for you to use when you file your entity formation documents. You can also do this online. You will have to pay a filing fee of $10.00. Name reservations are valid for 60 days.
